Terms of Service

Version 1.0 — Effective June 7, 2026

These Terms of Service ("Terms") govern your use of the Saddlebrook Homeowners Association website and member portal at saddlebrookomaha.com ("the Service"), operated by the Saddlebrook HOA board of directors ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The member portal is available exclusively to homeowners and residents of the Saddlebrook neighborhood in Omaha, Nebraska who are members of the Saddlebrook HOA. By creating an account, you represent that you are a current homeowner or authorized resident within the Saddlebrook community.

2. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and truthful information during registration.
  • You must not share your account with others or allow unauthorized access.
  • You are responsible for all activity that occurs under your account.
  • You must notify the HOA board immediately if you suspect unauthorized use of your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, threaten, or abuse other members through the Service
  • Submit false or misleading information
  • Attempt to access accounts or data belonging to other members
  • Interfere with or disrupt the operation of the Service
  • Use automated tools to access the Service without prior written consent

4. HOA Dues and Payments

  • Dues amounts and schedules are set by the HOA board in accordance with the community's covenants and bylaws.
  • Payments made through the Service are processed by Stripe. By making a payment, you also agree to Stripe's terms of service.
  • The Service provides payment records for convenience but does not replace official HOA financial statements.
  • Refunds, disputes, and payment plans are handled by the HOA board, not through the Service.

5. Community Communications

By creating an account, you consent to receive HOA-related communications including announcements, meeting notices, dues reminders, and voting notifications. You may opt out of non-essential communications through your account preferences, but certain critical communications (dues notices, legal matters) cannot be opted out of while you remain a member.

6. Voting

The Service may be used to conduct HOA votes and elections. Each member household is entitled to one vote per ballot as defined by the HOA bylaws. You agree not to vote on behalf of another household or attempt to manipulate voting results.

7. Content and Documents

Documents and information provided through the Service (meeting minutes, financial reports, covenants) are for the exclusive use of Saddlebrook HOA members. You agree not to redistribute this content publicly without board approval.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Account Termination

  • You may request account deletion at any time by contacting the board.
  • The board may suspend or terminate accounts that violate these Terms or are no longer associated with a Saddlebrook property.
  • Upon termination, your access to member-only features will be revoked. Financial records may be retained as required by law.

10. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties of any kind. The Saddlebrook HOA and its board members are not liable for any damages arising from your use of the Service, including but not limited to service interruptions, data loss, or errors in payment processing.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the version number and effective date at the top of this page. If changes are material, we will notify members through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Nebraska. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Douglas County, Nebraska.
